Non-PEO Disclosure

Effective Date: January 24, 2025

This disclosure is provided to ensure clarity and transparency regarding the employment and contractual relationships associated with services offered by LoveWorks Staffing, LLC DBA WORKS™ (“WORKS™”).

1. Employment and Contractor Relationship
All team members, including but not limited to those performing services under any agreement with WORKS™, are employees or contractors of WORKS™ and its related entities. These team members are not employees of any client company or customer that engages WORKS™ for services.

2. Responsibility for Employment Obligations

WORKS™ and its related entities retain full responsibility for all employment obligations associated with their team members. This includes, but is not limited to, payroll, benefits, workers’ compensation, compliance with applicable labor laws, and any other legal or regulatory responsibilities. WORKS™ does not share or transfer any of these responsibilities to its clients or customers.

3. Non-PEO Status
WORKS™ is not a Professional Employer Organization (PEO) and does not engage in co-employment arrangements. WORKS™ operates as an independent nearshore fulfillment center, providing staffing, virtual assistance, and other professional services to its clients under business-to-business service agreements. As such, WORKS™ does not assume or share employer responsibilities with its clients or customers.

4. Customer Obligations
Clients and customers of WORKS™ are not considered employers of any team member provided by WORKS™ and its related entities. Customers are responsible for fulfilling their obligations under the service agreements executed with WORKS™, but they bear no employer-related responsibilities for team members assigned to perform services.

5.Compliance and Accountability
WORKS™ and its related entities comply with all applicable labor and employment regulations within their jurisdiction and assume full accountability for the actions and responsibilities of their team members.

By engaging WORKS™ services, clients acknowledge and agree to the terms outlined in this disclosure. This document is intended to eliminate any confusion regarding the roles and responsibilities of WORKS™, its team members, and its clients.
